These Terms and Conditions set out the basis on which waste collection services are provided to customers in South Kensington and surrounding areas. By requesting, booking or using the waste collection service, you agree to be bound by these Terms and Conditions. Please read them carefully before placing a booking.
Definitions
In these Terms and Conditions, the following expressions have the meanings set out below:
Customer means any individual, business or organisation requesting or receiving waste collection services.
Service Provider means the company or entity supplying the waste collection service.
Services means any waste collection, removal, clearance, loading, transporting and related services provided at the customer premises or agreed location.
Premises means the address or site where the services are to be carried out.
Waste means any items, materials or rubbish presented for collection, including household waste, commercial waste, bulky items and similar discardable materials, but excluding any prohibited or hazardous waste as defined in these Terms and Conditions or in applicable legislation.
Scope of Services
The service provider offers waste collection services in South Kensington and nearby areas, including but not limited to the collection, loading and removal of domestic and commercial waste. The exact scope of the services for each booking will be described in the booking confirmation.
Services may cover one-off waste clearances, regular scheduled collections, bulky waste removal, and other agreed waste management activities. The service provider reserves the right to decline any request for services at its sole discretion, including where the requested service is outside the usual service area or involves waste types that cannot lawfully or safely be collected.
Booking Process
Customers may request waste collection services by telephone, email, online enquiry or any other method made available by the service provider. All bookings are subject to availability and are not confirmed until the customer receives explicit confirmation from the service provider.
When making a booking, the customer must provide accurate and complete information, including:
Full name or business name.
Contact details.
Service address in or near South Kensington.
Type and approximate volume or weight of waste.
Any access restrictions or special requirements at the premises.
The service provider will use the information supplied to estimate the time, resources and charges for the services. If, on arrival, the actual volume or nature of the waste differs significantly from the information provided, the service provider may vary the price, alter the service to reflect what is reasonably achievable, or decline to carry out all or part of the services.
The customer is responsible for ensuring that a suitably authorised person is present at the premises at the agreed time to grant access, confirm the items to be collected and sign any required documentation.
Service Charges and Payment Terms
The price for the services will be communicated to the customer at the time of booking or in the booking confirmation. Charges may be based on factors such as type of waste, estimated volume, loading time, access conditions, distance travelled and disposal costs.
All prices are quoted exclusive of any applicable taxes unless otherwise stated. Any applicable taxes will be added to the quoted prices and shown on the final invoice.
Payment terms will be advised at the time of booking. The service provider may require:
Full payment in advance.
A deposit at the time of booking, with the balance payable on completion of the services.
Payment on account for approved business customers, subject to specific credit terms.
Accepted payment methods will be notified to the customer and may include card payments, bank transfers or other methods agreed in advance. All payments must be made in the currency specified by the service provider.
If payment is not received in accordance with the agreed terms, the service provider may suspend or cancel the services, charge interest on overdue amounts at the maximum rate permitted by law, and recover any reasonable costs incurred in pursuing late payment.
Cancellations, Rescheduling and Access
The customer may cancel or reschedule a booking by contacting the service provider as early as possible. Cancellations or changes are only effective once acknowledged by the service provider.
The following rules will normally apply, unless otherwise stated in the booking confirmation:
If the customer cancels more than 24 hours before the scheduled collection time, any prepaid amount may be refunded or transferred to a new booking, subject to a reasonable administration fee where applicable.
If the customer cancels within 24 hours of the scheduled collection time, the service provider may retain all or part of any deposit or prepayment to cover costs and lost booking time.
If the customer fails to provide access to the premises at the agreed time, or if no authorised person is present, this may be treated as a late cancellation. The service provider may charge a call-out fee and any waiting time as per its usual rates.
The service provider reserves the right to cancel or reschedule a booking where necessary due to operational reasons, safety concerns, vehicle breakdowns, extreme weather or other circumstances beyond its reasonable control. In such cases, the service provider will endeavour to give the customer as much notice as possible and offer an alternative appointment or a refund of any amount paid for the affected service.
Customer Responsibilities
The customer is responsible for ensuring that:
Safe and reasonable access is available to the premises and the waste to be collected.
Parking arrangements for collection vehicles are lawful and practical, and any necessary permits are in place.
The waste has been accurately described to the service provider, and that no prohibited or hazardous items are included unless explicitly agreed in writing.
All items the customer wishes to keep are clearly separated from the waste to be collected.
The customer must not request the collection of any waste that is prohibited by law or that the service provider has specifically declined to collect. If restricted waste is found among the items presented for collection, the service provider may refuse to collect those items and may charge the customer for any additional handling, segregation or disposal costs incurred.
Waste Types and Regulations
All services are provided in accordance with applicable waste management and environmental regulations in the United Kingdom. The service provider will use licensed facilities for the transfer, recycling or disposal of waste and will take reasonable steps to manage waste responsibly.
Certain types of waste cannot be collected without prior agreement or may be completely prohibited. Prohibited or restricted items may include, but are not limited to:
Hazardous substances such as chemicals, solvents and asbestos.
Clinical or medical waste.
Pressurised containers such as gas cylinders.
Explosive or highly flammable materials.
Liquid waste other than small quantities of household cleaning products.
Electrical and electronic equipment that requires specialist handling, unless specifically agreed.
The customer must disclose any such items in advance. Where the service provider agrees to collect specialist waste, additional charges and specific conditions may apply.
Once the waste has been loaded onto the collection vehicle, it becomes the property of the service provider or its waste management partners. The service provider will then be responsible for managing the waste in accordance with applicable regulations.
Liability and Limitations
The service provider will use reasonable care and skill in performing the services. However, liability to the customer is limited as follows, to the fullest extent permitted by law:
The service provider is not liable for any loss, damage or costs arising from inaccurate information provided by the customer, including incorrect description of waste, access issues or failure to disclose prohibited items.
The service provider is not liable for any indirect or consequential loss, including loss of profits, loss of business, loss of opportunity or loss of goodwill.
Total liability for direct losses resulting from any single event or series of connected events shall not exceed the total price paid or payable by the customer for the specific services giving rise to the claim.
The customer is responsible for checking that only waste items are removed and that no items intended to be retained are inadvertently included. The service provider cannot accept responsibility for any items removed in error where they were not clearly separated or identified as items to be kept.
Nothing in these Terms and Conditions excludes or limits liability for death or personal injury caused by negligence, for fraud, or for any other liability that cannot be excluded or limited by law.
Damage to Premises
The service provider will take reasonable care to avoid damage when loading and removing waste. However, the customer acknowledges that some marking or minor damage can occur during the movement of heavy or bulky items, particularly where there are tight access routes, narrow stairways or fragile surfaces.
The customer must inform the service provider of any particular risks at the premises, such as weak floors, loose fittings, or valuable surfaces. The service provider may decline to move items in situations where the risk of damage is considered excessive.
If damage occurs as a direct result of negligence on the part of the service provider, the customer must notify the service provider in writing as soon as reasonably practicable, providing details and evidence of the alleged damage. The service provider may arrange an inspection and will, at its discretion, repair the damage, arrange for repair, or offer reasonable compensation, subject to the overall limitations of liability described in these Terms and Conditions.
Delays and Events Beyond Control
The service provider will make reasonable efforts to attend the premises at the agreed time. However, time is not guaranteed, and the service provider is not liable for any delay or failure to perform the services caused by events beyond its reasonable control. These may include traffic congestion, road closures, extreme weather, accidents, vehicle breakdowns, industrial action, or compliance with legal requirements.
Where an event beyond the control of the service provider prevents or delays performance, the service provider will notify the customer as soon as practicable and will either rearrange the service or, where appropriate, cancel the booking and refund any amount paid for services not carried out.
Data Protection and Privacy
The service provider may collect and process personal data about customers in order to manage bookings, provide services, process payments and communicate regarding services. Personal data will be handled in accordance with applicable data protection laws in the United Kingdom.
Customer information may be shared with employees, contractors and service partners who need the information to carry out the services, as well as with lawful authorities where required. The service provider will take reasonable steps to keep personal data secure and to protect it from unauthorised access or disclosure.
Complaints and Dispute Resolution
If the customer is dissatisfied with any aspect of the services, they should contact the service provider as soon as possible, providing full details of the issue. The service provider will investigate complaints promptly and aim to resolve them fairly.
Most concerns can be resolved directly between the customer and the service provider. If a dispute cannot be resolved through informal discussions, the parties may consider mediation or other forms of alternative dispute resolution. This does not affect the right of either party to pursue legal remedies through the courts.
Amendments to Terms and Conditions
The service provider may update or amend these Terms and Conditions from time to time to reflect changes in the law, operational requirements, or service offerings. The latest version will apply to new bookings from the date it is made available.
For ongoing or scheduled services, the service provider will inform the customer of any significant changes that affect their existing arrangements. Continued use of the services after notification of changes will be treated as acceptance of the revised Terms and Conditions.
Governing Law and Jurisdiction
These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the provision of waste collection services, shall be governed by and construed in accordance with the laws of England and Wales.
The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising from or relating to these Terms and Conditions or the services, whether contractual or non-contractual.
Severability
If any provision of these Terms and Conditions is found by a court or competent authority to be invalid, unlawful or unenforceable, that provision shall be deemed severed from the remaining provisions, which shall continue to be valid and enforceable to the fullest extent permitted by law.
Entire Agreement
These Terms and Conditions constitute the entire agreement between the customer and the service provider in relation to the provision of waste collection services in South Kensington and surrounding areas. They supersede any prior understandings, representations or agreements, whether written or oral, relating to the same subject matter.
No variation of these Terms and Conditions shall be effective unless expressly agreed in writing by an authorised representative of the service provider.
